According to the most recent data, in 2022, most of the over 1.4 million new civil cases, specifically more than 75%, were filed in municipal and justice courts. This represents a significant shift in the distribution of civil case filings compared to a decade ago, when municipal courts accounted for nearly half of all filings. However, in 2019, justice courts overtook municipal courts regarding the number of civil cases filed.

There was an uptick in the number of new cases filed in district and county-level courts across seven categories. The most significant increase was observed in civil cases linked to criminal matters. Conversely, the largest decreases in filings in these courts were in cases related to debt and motor vehicle injury/damage, both of which are substantial case categories. However, compared to five years ago, it’s important to note that filings in nearly all categories remain notably lower.

Before the pandemic, the two categories that experienced the most substantial growth were motor vehicle injury/damage cases and debt cases. However, in 2022, there was a significant shift in these trends.

In 2022, motor vehicle injury/damage cases saw a 16% decrease compared to the previous year, reaching the lowest level since 2017 despite reaching an all-time high in 2021. On the other hand, other injury/damage cases not involving motor vehicles increased by 10% in 2022. These include Texas malpractice, product liability, and other injury/damage cases. Interestingly, these non-motor vehicle injury/damage cases have gradually increased since hitting an all-time low in 2017.
