New Study Criticizes Nursing Home Regulators |

This should not be a shock, but a new study released by the Government Accountability Office finds that the Bush Administration is doing a poor job of oversight of the nursing home industry. While many nursing homes provide great care, it is sad when we fail our responsibility to make sure that unscrupulous providers take advantage of those that are unable to take care of themselves. With the government not properly regulating the industry, then abuses occur, and litigation becomes more common and becomes one of the final ways to police those that choose to shirk their responsibility. Unfortunately, nursing home lawsuits in Texas have taken a real hit since the 2005 round of tort reform. With the new limits on awards for pain and suffering, it is not economically feasible to pursue claims against nursing unless they involve the most egregious conduct or damages.
