Austin NBC affiliate KXAN ran a story last night called Deciding When Elderly Drivers Should Turn Over the Keys. It discusses the tough issues facing drivers in Austin and around the country that have to weigh the risk of their continued driving versus their freedom. We thought it was a good story that raises issues that need to be addressed. But perhaps the story didn’t go far enough. Like most personal injury attorneys and lawyers, we’ve seen far too many instances where car wrecks or accidents occur because someone refuses to quit driving when they have a health condition that can make them dangerous to themselves or others. In fact, just this morning, Brooks was in a deposition in a personal injury case where a defendant discussed a wreck she had caused because she blacked out from her diabetes. While there is certainly no claim that she shouldn't be driving just because she had diabetes, she now realizes that checking blood sugar levels before getting behind the wheel can be a life or death decision. While we all enjoy the freedom to drive, perhaps we should think a little more long-term about our safety and that of others.
