Any Relief In Sight For Injured Workers? |

I have previously written about the Texas Supreme Court's opinion of Entergy Gulf States, Inc. v. Summers. The opinion allowed property owners to buy their way out of lawsuits brought by employees of contractors or subcontractors working on the owner's property by purchasing worker's compensation insurance that covers the contractors' or subcontractors' employees. After the opinion was handed down, there was a lot of firestorm, including a bi-partisan group of state legislators filing an amicus brief asking the Court to reverse itself. The court has granted a rehearing, but no word on the result. My previous posts are here, here, and here.
Yesterday, Austin American Statesman journalist Kate Alexander wrote another story about the case and its consequences. In this article, she tells the story of Jose Herrera, a contract work in oil and gas refineries, who was disabled after 550 degree crude oil scorched 1/3 of his body. It is a compelling story, and I urge anyone interested in worksite safety to read it.
